Terms of Service

Welcome to Findin! These Terms of Service ("Terms") govern your access to and use of the Findin platform, including our websites, mobile applications, and all associated services (collectively, the "Platform"). The Platform is owned and operated by FINDIN (SMC-PRIVATE) LIMITED ("Findin," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Acceptance of Terms

By accessing or using the Findin Platform, you affirm that you are at least 18 years old and capable of entering into a binding contract, and you agree to these Terms. If you are accessing or using the Platform on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Changes to Terms

Findin reserves the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on the Platform or by sending you an email notification. Your continued use of the Platform after such modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Platform.

3. Eligibility

The Platform is intended for use by individuals who are at least 18 years old. By using the Platform, you represent and warrant that you meet this age requirement.

4. Your Account

To access certain features of the Platform, you may need to register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Findin immediately of any unauthorized use of your account.

5. Our Services

Findin is a discovery directory that helps people find and connect with local places, experiences, and businesses. Examples of what you can discover include:

Menu & Food (restaurants, cafes, bars, food trucks)
Fitness & Sports (gyms, yoga, personal training)
Beauty & Lifestyle (spas, salons, wellness)
Entertainment (cinema, theater, gaming, concerts)
Parks & Attractions (theme parks, museums, tours)
Events & Venues (event spaces, photography, party planning)
Retail & Shopping (boutiques, souvenirs, local products)

Findin acts solely as a discovery platform to connect people with local places, experiences, and businesses. We do not own, operate, or provide the listings, Local Picks, or offerings featured on the Platform.

6. Reservations and Payments (Discovery Phase)

6.1. Connecting & Inquiries

Findin facilitates discovery and connection. The typical journey is:

Initiate Contact: Select your desired listing and send an inquiry or contact the business directly using the details provided.
Review & Agree Off-Platform: Review and agree to the business terms, including any cancellation policy, directly with them.
Direct Contract with Business: Your agreement is directly with the business; Findin facilitates discovery and connection.

6.2. Payment Terms

Findin does not currently process payments or hold funds. Any payments occur off-platform directly between you and the business. If Findin introduces on-platform payments in the future, updated terms and fees will apply and will be communicated in advance.

6.3. Cancellations and Refunds

Findin does not manage cancellations or refunds at this stage. Any cancellations, changes, or refunds are handled directly between you and the business based on their own policies.

7. Business Listings & Content Labeling

7.1. Types of Listings

Findin is a discovery-first platform featuring two types of listings:

Local Picks: User-generated spots shared by community members highlighting unique and favorite local places.
Business Listings: Venues listed by businesses with access to business tools including offerings, bookings, reservations, and analytics.

All listings must provide accurate and complete information. Businesses are responsible for keeping their offerings, pricing, availability, and contact details up to date. All listings must comply with Findin's policies, including the Nondiscrimination Policy and Acceptable Use Policy.

7.2. Content Transparency & Labeling

We clearly label all content to maintain transparency:

Local Pick: User-generated content and spots shared by community members.
Business: Official business listings with verified business tools and features.
Sponsored: Paid promotional content, partnerships, or featured placements clearly marked as sponsored.

7.3. Business Responsibilities

Businesses using the platform are responsible for:

Ensuring the accuracy of their listings and offerings.
Providing quality service and maintaining professional standards.
Communicating promptly and professionally with users.
Honoring bookings and reservations made through business tools.
Complying with all applicable laws, including licensing, zoning, tax regulations, and business permits.

8. User Content

You are solely responsible for any content you post on the Findin Platform, including photos, reviews, and messages ("User Content"). By posting User Content, you grant Findin a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, distribute, and display your User Content in connection with the Platform and Findin's business operations. You represent and warrant that you have all necessary rights to grant this license.

9. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

Violating any applicable laws or regulations.
Infringing on the rights of others, including intellectual property rights.
Posting false, misleading, or deceptive information.
Engaging in any fraudulent or illegal activity.
Harassing, stalking, or defaming other users.
Using the Platform for any commercial purpose not expressly permitted by Findin.
Interfering with the operation of the Platform, including introducing viruses or other malicious code.
Collecting or storing personal data about other users without their consent.

10. Intellectual Property

All content on the Findin Platform, including text, graphics, logos, images, and software, is the property of Findin or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use any content from the Platform without our express written permission.

11. Disclaimers

THE FINDIN PLATFORM AND ALL CONTENT, SERVICES, AND PRODUCTS PROVIDED THROUGH THE PLATFORM ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FINDIN DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FINDIN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT FINDIN HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

13. Indemnification

You agree to indemnify, defend, and hold harmless Findin, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the Platform.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts located in Pakistan.

15. General Provisions

These Terms constitute the entire agreement between you and Findin regarding the Platform and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Findin. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Findin's failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

16. Termination & Suspension

We may suspend or terminate your access to the Platform (in whole or in part) at any time, with or without notice, if we reasonably believe: (a) you violated these Terms or our policies; (b) your use creates risk or possible legal exposure for us or our community; or (c) we are required to do so by law. You may stop using the Platform at any time. Upon termination, any provisions which by their nature should survive (e.g., intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.

17. Monitoring & Enforcement

We may monitor use of the Platform to ensure compliance with these Terms; remove or restrict access to content; and take enforcement actions described in our Content Moderation & Takedown Policy and Acceptable Use Policy.

18. Third-Party Services & Integrations

The Platform may contain links to or integrate with third-party services (e.g., maps, analytics, payment providers in the future). Your use of third-party services is governed by their terms and privacy policies. We are not responsible for third-party services and do not endorse or assume liability for them.

19. Changes to the Platform

We may change, suspend, or discontinue any part of the Platform at any time, including features or content. We will try to give reasonable notice of material changes where practicable.

20. Beta & Experimental Features

We may offer features identified as beta, preview, or experimental. These features are provided "as is," may be subject to additional terms, and can be modified or discontinued at any time.

21. No Agency

Nothing in these Terms shall be construed to create any partnership, joint venture, employment, or agency relationship between you and Findin. Businesses and community contributors (including Local Pick creators) are independent third parties and are not controlled by Findin. Listings and Local Picks are third‑party content; Findin does not endorse or guarantee the accuracy of any such content.

22. Force Majeure

Findin shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet or telecommunications failures, or power outages.

23. Policies Incorporated by Reference

The following policies are incorporated into these Terms by reference and form part of your agreement with us: Privacy Policy, Cookie Policy, Acceptable Use Policy, Reviews & Ratings Policy, Content Moderation & Takedown Policy, Intellectual Property Policy, Nondiscrimination Policy, Advertising & Sponsorship Disclosure, and Affiliate Disclosure.
