Findin Terms of Service

Welcome to Findin! These Terms of Service ("Terms") govern your access to and use of the Findin platform, including our websites, mobile applications, and all associated services (collectively, the "Platform"). The Platform is owned and operated by FINDIN (SMC-PRIVATE) LIMITED ("Findin," "we," "us," or "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

1. Acceptance of Terms

By accessing or using the Findin Platform, you affirm that you are at least 18 years old and capable of entering into a binding contract, and you agree to these Terms. If you are accessing or using the Platform on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Changes to Terms

Findin reserves the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on the Platform or by sending you an email notification. Your continued use of the Platform after such modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Platform.

3. Eligibility

The Platform is intended for use by individuals who are at least 18 years old. By using the Platform, you represent and warrant that you meet this age requirement.

4. Your Account

To access certain features of the Platform, you may need to register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Findin immediately of any unauthorized use of your account.

5. Our Services

Findin provides an online marketplace that enables users to:

Browse and book unique accommodations ("Stays").
Discover and book local activities and tours ("Experiences").
Book curated travel itineraries ("Travel Packages").

Findin acts solely as a platform to connect hosts and guests. We do not own, operate, or provide any Stays, Experiences, or Travel Packages ourselves.

5.1. Stays

Hosts offer various types of accommodations, from apartments and houses to unique properties. Listings for Stays include descriptions, photos, pricing, availability, and house rules. Guests are responsible for reviewing these details carefully before booking.

5.2. Experiences

Hosts offer Experiences, which are activities or tours led by local experts. Each Experience listing details the activity, duration, inclusions, exclusions, and any special requirements. Guests are responsible for ensuring they meet the eligibility criteria for participating in an Experience.

5.3. Travel Packages

Findin offers pre-arranged Travel Packages that may include Stays, Experiences, and transportation. The details of each package, including itinerary, inclusions, and pricing, are clearly outlined in the listing. By booking a Travel Package, you agree to the specific terms and conditions applicable to that package.

6. Booking and Payments

Select your desired Stay, Experience, or Travel Package on the platform.

Review & Agree to Terms

Carefully read and accept the host's terms and cancellation policy.

Direct Contract with Host

Your agreement is directly with the host; Findin facilitates the connection.

6.2. Payment Terms

You agree to pay all fees associated with your bookings, including the listing price, Findin service fees, and any applicable taxes. Payments are processed securely through our third-party payment processors. You authorize Findin to charge your chosen payment method for all amounts due.

6.3. Cancellations and Refunds

Cancellation and refund policies vary depending on the specific listing and host. Please review the cancellation policy carefully before confirming your booking. Findin's service fees are generally non-refundable.

7. Host Terms

7.1. Listing Your Space/Experience

As a host, you can create listings for Stays, Experiences, or Travel Packages. You are responsible for providing accurate and complete information about your listing, including availability, pricing, and any house rules. All listings must comply with Findin's policies, including the Nondiscrimination Policy and Acceptable Use Policy.

7.2. Host Responsibilities

Hosts are responsible for:

Ensuring the accuracy of their listings.
Providing a safe and clean environment for guests.
Communicating promptly and professionally with guests.
Honoring all confirmed bookings.
Complying with all applicable laws, including licensing, zoning, and tax regulations.

7.3. Payments to Hosts

Findin will collect payments from guests on your behalf and disburse them to you, minus any applicable Findin service fees. Payouts are typically processed within a few business days after the guest's check-in or experience start date.

8. User Content

You are solely responsible for any content you post on the Findin Platform, including photos, reviews, and messages ("User Content"). By posting User Content, you grant Findin a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, distribute, and display your User Content in connection with the Platform and Findin's business operations. You represent and warrant that you have all necessary rights to grant this license.

9. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

Violating any applicable laws or regulations.
Infringing on the rights of others, including intellectual property rights.
Posting false, misleading, or deceptive information.
Engaging in any fraudulent or illegal activity.
Harassing, stalking, or defaming other users.
Using the Platform for any commercial purpose not expressly permitted by Findin.
Interfering with the operation of the Platform, including introducing viruses or other malicious code.
Collecting or storing personal data about other users without their consent.

10. Intellectual Property

All content on the Findin Platform, including text, graphics, logos, images, and software, is the property of Findin or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use any content from the Platform without our express written permission.

11. Disclaimers

THE FINDIN PLATFORM AND ALL CONTENT, SERVICES, AND PRODUCTS PROVIDED THROUGH THE PLATFORM ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FINDIN DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FINDIN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT FINDIN HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

13. Indemnification

You agree to indemnify, defend, and hold harmless Findin, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the Platform.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts located in Pakistan.

15. General Provisions

These Terms constitute the entire agreement between you and Findin regarding the Platform and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Findin. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Findin's failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
